About the Conference

Overview

Canada's Anti-Spam Legislation (CASL) was passed by the Canadian federal government on December 15, 2010. It introduces significant changes for big and small businesses in how they can market products and services to Canadian customers and clients using direct electronic mail and messaging.

Businesses will have to obtain consent before marketing to customers and clients by direct email or text. They will face penalties of and exceeding $1,000,000 for violations. Liability for breach extends to anyone involved in sending commercial electronic messages and there are provisions to combat and eliminate spyware and phishing. The new law will be enforced by the CRTC, the Competition Bureau and the Privacy Commissioner of Canada.

Reboot Communications will present a one-day conference aimed at email service providers, e-marketers, advertising agencies, legal counsel and other business interests that routinely engage in e-marketing techniques and technology to communicate with their customers and clients. The conference will feature presentations by several prominent Canadian legal and business experts from both the public and private sectors.

While the one-day Conference on Canada’s Anti-Spam Legislation (“CASL”) explores some of the most important issues for senders under the legislation, this pre conference seminar serves as a primer for anyone seeking to learn a bit more about exactly what is in the law, and how it applies to them. The instructor, Shaun Brown, has extensive knowledge of CASL and how it applies to all stakeholders in the e-marketing environment, including advertisers (large and small), email service providers, and non-profit organizations. In particular, the seminar will provide:

  • A clear and concise overview of the key requirements under CASL, the Competition Act and the and the Personal Information Protection and Electronic Documents Act when sending commercial electronic messages;
  • A description of how CASL differs from the U.S. CAN-SPAM Act, and why CASL effectively creates a new North American standard;
  • Practical guidance and several tips on how to comply with the legislation; and,
  • An overview of enforcement and penalties under the law, and how to avoid being penalized for ‘honest mistakes’.

This seminar will be helpful for even those who have little or no knowledge about the legislation, and participants with more advanced knowledge are encouraged to come prepared to raise any questions that they may have about the law and how it applies to their specific situation.
